Can mediation work for your divorce?

Mediation is fast becoming one of the most common methods for settling a divorce or separation. Mediation can be more effective, more affordable and can lead to more satisfactory outcomes in comparison to cases taken through the courts.

Here's how the process works.

The first step

A very common reason people don't want to use mediation is that they are concerned their partner won't be willing to agree to the initial meeting. Don't use this as a reason for dismissing the whole process. Use your chosen mediator to help set up and negotiate the first session and organise the first meeting. Often the biggest barrier is getting to this session but once the process starts it's amazing how quickly both parties want to reach a settlement.

The process

The mediation process usually starts with a phone call to hear more about your issue and your background. At Limerick Mediation, this call is completely free and is a non-committal way to hear more about the process.

Once this has been completed, your mediator will then set up a mutually beneficial location for the first meeting. The mediator will walk you through the process, what you can expect and aim to make you feel comfortable.

After the mediator has covered the basics, both parties will be able to give an overview of their situation. The mediator will ask question to clarify certain points or to get more information. The next step is to asses where you and your spouse agree on certain points and get confirmation. On the points where you disagree, the mediator will work to collect more information and to see where an agreement can be reached. This can be a sensitive section of the process but your mediator will work to make sure that it's fair and efficient. A follow up meeting will be used to solve further disagreements.

Completing the Agreement

Once your sessions are completed and you have reached an agreement, your mediator will write up a document of the terms. These documents are signed by both parties and you are free to have your solicitor look over the terms if needed before signing. If you do need to go to court following your mediation, these terms can be submitted for a judge to review and be used in their judgement.
